Welcome to SnapShare ("SnapShare," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the SnapShare website, apps, and services (collectively, the "Service"). By creating an account, uploading content, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Acceptance of Terms
By accessing or using SnapShare, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. We may update these Terms from time to time as described in Section 13.
2. Eligibility & Accounts
- You must be at least 13 years old (or the minimum age of digital consent in your country) to create a SnapShare account.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- You must provide accurate registration information and keep it up to date.
- One person or entity may not maintain multiple accounts for abusive or deceptive purposes.
3. Your Content
"Your Content" means any photos, captions, comments, profile information, or other material you upload, post, or submit to SnapShare. You retain all ownership rights in Your Content. Uploading content does not transfer ownership to SnapShare.
You are solely responsible for Your Content and for ensuring you have the necessary rights, permissions, and consents (including from any identifiable people in your photos) to share it on SnapShare.
4. License You Grant to SnapShare
By posting Your Content, you grant SnapShare a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, and distribute Your Content solely for the purposes of operating, promoting, and improving the Service (for example, displaying your photo in feeds, search results, or thumbnails). This license ends when you delete Your Content or your account, except where copies have been shared by other users or are needed for backups, legal compliance, or dispute resolution.
5. Acceptable Use
When using SnapShare, you agree to:
- Respect other members' rights, privacy, and content.
- Use the Service only for lawful purposes.
- Not interfere with or disrupt the Service, including through scraping, bots, or automated data collection without permission.
- Not attempt to circumvent security features or access accounts that are not yours.
6. Prohibited Content
You may not upload or share content that:
- Is illegal, or exploits or endangers minors in any way.
- Infringes another party's copyright, trademark, or other intellectual property rights.
- Is sexually explicit, or depicts non-consensual intimate imagery.
- Harasses, threatens, defames, or incites violence against any person or group.
- Contains malware, spam, or deceptive links.
- Violates any applicable local, state, national, or international law.
7. Intellectual Property & Copyright (DMCA)
SnapShare respects intellectual property rights and expects members to do the same. If you believe content on SnapShare infringes your copyright, please send a notice to team@snapshare.fun including:
- A description of the copyrighted work you believe has been infringed.
- The URL or location of the allegedly infringing content on SnapShare.
- Your contact information (name, address, phone number, email).
- A statement that you have a good-faith belief the use is unauthorized.
- A statement, under penalty of perjury, that the information in the notice is accurate and you are authorized to act on behalf of the rights owner.
- Your physical or electronic signature.
We will respond to valid notices in accordance with applicable law, which may include removing the reported content and, for repeat infringers, terminating accounts.
8. Moderation & Enforcement
We may review, remove, or restrict access to content that we determine, in our discretion, violates these Terms or is otherwise objectionable, with or without notice.
9. Suspension & Termination
We may suspend or terminate your account if you violate these Terms, misuse the Service, or create risk or legal exposure for SnapShare. You may delete your account at any time from your account settings. Sections that by their nature should survive termination (including Sections 6, 7, 10, 11, and 12) will continue to apply.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Service will be uninterrupted, secure, or error-free, or that content will be accurate or reliable.
11. Limitation of Liability
To the fullest extent permitted by law, SnapShare and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service, even if advised of the possibility of such damages.
12. Indemnification
You agree to indemnify and hold SnapShare harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.
13. Changes to These Terms
We may modify these Terms from time to time. If we make material changes, we will provide notice (for example, via the Service or email) before the changes take effect. Continued use of SnapShare after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of the jurisdiction in which SnapShare operates, without regard to conflict-of-law principles. [Insert your specific governing jurisdiction here, e.g., "the Islamic Republic of Pakistan" or a specific U.S. state, once finalized.]
